Terms of Service

By creating an account, subscribing to our service, or using the Prompt Optimizer platform (including our cloud API, web interface, or NPM package), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

These terms apply to all users of our hybrid prompt optimization platform, including direct API consumers, web interface users, and those using our local MCP bridge package.

Prompt Optimizer is a hybrid AI prompt enhancement platform consisting of:

• Cloud-hosted optimization engine with enterprise-grade infrastructure

• Web-based dashboard for direct optimization and account management

• RESTful API for programmatic access and custom integrations

• NPM package (mcp-prompt-optimizer) providing local MCP bridge functionality

• Support for 17+ AI development tools including Claude Desktop, Cursor, and Windsurf

• Automatic template saving system with comprehensive optimization history

The service combines cloud-based processing power with flexible deployment options to meet diverse workflow requirements.

Our platform operates using a hybrid architecture:

Cloud Infrastructure:

• Primary optimization engine hosted on enterprise-grade cloud infrastructure

• FastAPI backend deployed on Northflank with 99.9% uptime SLA

• PostgreSQL database via Supabase for template storage and user management

• All optimization processing occurs in our secure cloud environment

Local Bridge Component:

• NPM package acts as local proxy between MCP clients and cloud API

• No sensitive data processing occurs locally

• Bridge simply forwards requests to cloud infrastructure

• Local configuration stores only API key for authentication

We offer three subscription tiers with distinct usage quotas and features:

**Explorer ($5.99/month):** 20 optimizations via web interface only, basic support

**Creator ($12.99/month):** 200 optimizations (web + API), 1 API key, template saving, priority support

**Innovator ($24.99/month):** 450 optimizations, up to 10 API keys, unlimited templates, dedicated support

Billing is processed monthly in advance through Stripe. All prices are in USD unless otherwise specified.

Subscriptions automatically renew unless cancelled. You may cancel at any time through your dashboard.

Usage quotas reset monthly on your billing date. Unused optimizations do not roll over.

Refunds are provided in accordance with our refund policy available in your account settings.

API Key Management:

• API access provided through secure API keys (sk-opt-* format)

• Keys generated and managed through your dashboard

• Creator plan: 1 API key, Innovator plan: up to 10 API keys

• API keys must be kept secure and confidential

NPM Package License:

• Our NPM package (mcp-prompt-optimizer) is licensed under Commercial License

• Package installation and usage requires active Creator or Innovator subscription

• Local bridge functionality connects MCP clients to our cloud API

• Technical support provided for integration issues with our package

Rate Limiting:

• Usage quotas enforced automatically based on subscription tier

• API rate limiting applied to prevent abuse

• Exceeding limits may result in temporary service restriction

Your Content Ownership:

• You retain all intellectual property rights in prompts, templates, and content you create

• We do not claim ownership of your prompts or optimization results

• Your saved templates remain your property and are accessible only to your account

Platform Intellectual Property:

• The Prompt Optimizer software (cloud API, web interface, NPM package) and related IP are owned by us

• Our optimization algorithms, backend infrastructure, and service code are proprietary

• NPM package code and distribution rights are protected by commercial license

License Grants:

• You grant us limited, non-exclusive license to process prompts solely for optimization services

• We grant you license to use our NPM package in accordance with your subscription tier

• Template data may be used in anonymized, aggregated form for service improvement

Cloud Data Handling:

• All prompt processing occurs in our secure cloud infrastructure

• Data encrypted in transit (HTTPS) and at rest (AES-256)

• Templates stored securely in Supabase with role-based access controls

• API keys encrypted using industry-standard hashing methods

Local Bridge Privacy:

• NPM package acts as pass-through proxy only

• No sensitive data stored or processed locally

• Local configuration contains only API key for authentication

• Bridge package does not cache or log prompt content

Data Retention:

• Optimization results saved as templates for your reference

• Templates retained for account lifetime plus 90 days after termination

• Data export available at any time through dashboard

• Complete data deletion available upon request

Automatic Template Creation:

• Every successful optimization automatically saved as structured template

• Rich metadata includes timestamps, goals, confidence scores, request IDs

• Templates linked to your account for privacy and audit trail

• Complete optimization history maintained for compliance and review

Template Access and Control:

• Templates accessible only through authenticated dashboard sessions

• API endpoints available for programmatic template retrieval

• Export functionality for data portability and backup

• Templates remain private and are never shared between accounts

Template Quotas:

• Explorer: No template saving

• Creator: Standard template limits (actively being developed)

• Innovator: Unlimited template storage and history

You may not use our service to:

• Generate, optimize, or process content that is illegal, harmful, or violates third-party rights

• Attempt to reverse engineer, modify, or extract our optimization algorithms

• Share, redistribute, or resell API access to unauthorized third parties

• Abuse rate limits, attempt to circumvent security measures, or overload our infrastructure

• Use the service to create competing prompt optimization platforms or services

• Distribute or modify our NPM package outside the terms of its commercial license

• Use automated tools to generate excessive optimization requests beyond normal usage patterns

Uptime and Reliability:

• We target 99.9% uptime for our cloud infrastructure

• Scheduled maintenance announced in advance when possible

• Service status updates provided through dashboard and status page

Support Tiers:

• Explorer: Community forum support and documentation

• Creator: Priority email support with 24-48 hour response time

• Innovator: Dedicated support channel with 12-24 hour response time

Technical Support:

• Integration assistance for NPM package and MCP client setup

• API documentation and code examples

• Troubleshooting guides for common issues

• Performance optimization recommendations

Voluntary Termination:

• You may terminate your account at any time through dashboard settings

• Subscription continues until end of current billing period

• Template data export available for 90 days post-termination

Involuntary Termination:

• We may suspend or terminate accounts for terms violations, non-payment, or service abuse

• Notice provided when possible, except for serious violations

• Appeal process available through support channels

Data Handling Upon Termination:

• API keys immediately revoked upon termination

• Template data retained for 90 days for recovery purposes

• Complete data deletion performed after retention period

• NPM package functionality ceases without valid subscription

MCP Client Compatibility:

• We provide integration support for Claude Desktop, Cursor, Windsurf, and other MCP clients

• Compatibility depends on proper client configuration and NPM package installation

• Third-party client updates may affect integration functionality

• We are not responsible for issues caused by third-party client software

NPM Package Distribution:

• Package distributed through official NPM registry

• Updates and version management handled through standard NPM processes

• Technical documentation provided for integration developers

• Commercial license terms apply to all package usage

Service Warranties:

• THE SERVICE IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND

• We do not guarantee optimization effectiveness for any particular use case

• AI-generated content may contain errors or inaccuracies requiring human review

Liability Limitations:

• Our liability limited to amount paid for service in 12 months preceding any claim

• Not liable for indirect, incidental, or consequential damages

• Force majeure events beyond our reasonable control excluded from liability

• Third-party service dependencies (Northflank, Supabase) may affect availability

Performance Disclaimers:

• Optimization results depend on prompt quality and selected goals

• Response times may vary based on system load and request complexity

• Template saving and retrieval subject to database availability

Term Updates:

• We may update these Terms of Service to reflect service changes or legal requirements

• Material changes announced through email and dashboard notifications 30 days in advance

• Continued service use after changes constitutes acceptance of updated terms

• Disagreement with changes allows account termination before effective date

Service Evolution:

• Platform features and capabilities may evolve based on user feedback

• New features may be introduced with additional terms or pricing

• Legacy functionality may be deprecated with reasonable notice period
